Terms and Conditions of Sale

This English version is provided for information purposes only. In the event of any discrepancy, the French version of these Terms and Conditions of Sale shall prevail. These sales are governed by French law.

Article 1. Purpose

These general terms and conditions of sale apply to all sales concluded by the company Alepia - La Maison d'Orient through the website www.alepia.com. The purchase of a product through this website implies the buyer's unreserved acceptance of these terms of sale, which the buyer acknowledges having read prior to placing their order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the website www.alepia.com is unrelated to their professional activity and is limited to strictly personal use and, on the other hand, that they have full legal capacity to enter into these general terms and conditions of sale. The company Alepia - La Maison d'Orient reserves the right to modify these terms of sale at any time, in order to comply with any new regulations or to improve the use of its website. Accordingly, the applicable terms shall be those in force on the date the buyer places their order.

Article 2. Products

The products offered are those featured on the website www.alepia.com of the company Alepia - La Maison d'Orient, while stocks last. The company Alepia - La Maison d'Orient reserves the right to modify its product range at any time. Photographs are provided for illustrative purposes only. We invite you to refer to the description of each product for its precise characteristics (volume, use, composition); should you have any doubt or wish to obtain information, please do not hesitate to contact the company La Maison d'Orient either by email at the following address: [email protected] or by telephone on +33 (0)1 56 32 32 25.

Article 3. Prices and Customs

The prices shown on the product pages of the online catalogue are prices in Euros (€), inclusive of all taxes, taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the products. The company Alepia - La Maison d'Orient reserves the right to modify its prices at any time, it being understood, however, that the price shown in the catalogue on the day of the order shall be the only price applicable to the buyer. The prices shown do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order and the place of delivery. Delivery within Metropolitan France is free from €30 (incl. tax) actually paid, after any discounts and discount codes have been applied (excluding delivery charges).
Customs and taxes outside the EU: For orders shipped outside the European Union, in particular to the United Kingdom, customs duties, local taxes or import duties may be payable. Such duties and amounts are not the responsibility of the company Alepia. They shall be borne by the buyer and fall under their sole responsibility, both in terms of declarations and payments to the competent authorities and bodies of their country.

Article 4. Discount Codes and Promotional Offers

The discount codes, vouchers and promotional offers distributed by the company Alepia - La Maison d'Orient (in particular by email or newsletter) are subject to the following conditions:

  • Unless expressly stated otherwise, promotional discount codes cannot be combined with one another: only one percentage discount code may be applied per order. They remain, however, combinable with free delivery, credit notes, gift vouchers and loyalty points.
  • Each code is valid only during its period of validity and within the limits of the conditions specific to the offer (minimum purchase amount, eligible products or categories, number of uses, etc.). An expired code, or one whose conditions are not met, cannot be applied, including where it has been entered in a shopping cart before its expiry date.
  • Discounts are not retroactive and cannot give rise to the refund of a difference on an order that has already been confirmed.
  • In the event of a technical error, a manifestly incorrect price, or the abusive or improper use of one or more codes (in particular an unauthorised combination), the company Alepia - La Maison d'Orient reserves the right to cancel the order concerned and to proceed with its full refund, without further compensation. The customer is then informed by email.

Article 5. Orders and Payment Methods

Before placing any order, the buyer must create an account on the website www.alepia.com. The account creation section is accessible directly from the side menu bar. On each visit, the buyer, if they wish to order or to view their account (order status, profile, etc.), must identify themselves using this information. The company Alepia - La Maison d'Orient allows the buyer to order and pay for their products in several steps, with 3 payment options to choose from:

  • Payment by cheque: the buyer selects the products they wish to order in the "cart", makes changes if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The delivery charges and the name of the carrier are then calculated and submitted to the buyer. The buyer then chooses their preferred payment method: "Payment by cheque". Finally, the last step invites them to check all the information, to read and accept these general terms and conditions of sale by ticking the corresponding box, and then invites them to confirm their order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon confirmation, the buyer receives an order form confirming the registration of their order. In order to finalise their payment and trigger the processing of their order, the buyer must print this order form and send it, together with their cheque made payable to "ALEPIA", to the following address: Alepia - 3 Avenue des Erables - 94440 Santeny, France. No cash payment should be sent. Only cheques issued by a French bank will be accepted. Upon receipt of the cheque, the order will be processed and the buyer will be informed by email. The company Alepia - La Maison d'Orient will ship the products at the earliest 2 working days after the cheque corresponding to the order has been cashed, subject to sufficient funds.
  • Payment by bank transfer: the buyer selects the products they wish to order in the "cart", makes changes if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The delivery charges and the name of the carrier are then calculated and submitted to the buyer. The buyer then chooses their preferred payment method: "Payment by bank transfer". In order to finalise their payment and trigger the processing of their order, the buyer must contact their bank in order to make the transfer corresponding to the amount of their order to the bank account of Alepia - La Maison d'Orient, the details of which are provided to the buyer. Upon receipt of the transfer, the order will be processed and the buyer will be informed by email. The company Alepia - La Maison d'Orient will ship the products at the earliest 2 working days after receipt of the transfer corresponding to the order, subject to sufficient funds.
  • Secure payment by PayPal or bank card (via the PAYBOX system): the buyer selects the products they wish to order in the "cart", makes changes if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The delivery charges and the name of the carrier are then calculated and submitted to the buyer. The buyer then chooses their preferred payment method: "Payment by PayPal". The next step invites them to check all the information, to read and accept these general terms and conditions of sale by ticking the corresponding box, and then invites them to confirm their order by clicking the "Confirm my order" button. Finally, the buyer is redirected to the secure PAYPAL interface in order to securely enter their PayPal account or personal bank card details. If the payment is accepted, the order is registered and the contract definitively formed. Payment by PayPal account or by bank card is irrevocable. In the event of fraudulent use of the card, the buyer may request cancellation of the card payment; the sums paid will then be re-credited or returned. The liability of a cardholder is not engaged if the disputed payment is proven to have been made fraudulently, remotely, without physical use of the card. To obtain a refund of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit, in writing, with their bank, within 70 days following the transaction, or even 120 days if the contract binding them to the bank so provides. The amounts debited are refunded by the bank within a maximum of one month after receipt of the written dispute submitted by the cardholder. No fee for the return of the sums may be charged to the cardholder.

Confirmation of an order entails acceptance of these terms of sale, acknowledgement of having full knowledge of them and waiver of the right to rely on the buyer's own purchasing terms. All the data provided and the recorded confirmation shall constitute proof of the transaction. If the buyer has an email address and has entered it on their order form, the company Alepia - La Maison d'Orient will send them confirmation of the registration of their order by email. If the buyer wishes to contact the company Alepia - La Maison d'Orient, they may do so either by email at the following address: [email protected] or by telephone on +33 (0)1 56 32 32 25.

Article 6. Right of Withdrawal - Returns

Pursuant to Article L221-18 of the French Consumer Code (Code de la consommation), any consumer is entitled to cancel their order at any time within a period of 14 calendar days following the date on which they received the Item(s), without having to justify their decision or pay any penalty, with the exception of return costs (see the model withdrawal form below), and provided that the Products are returned in their original packaging, complete, in perfect condition and unopened.

This withdrawal period expires 14 days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the Order.

In the event of failure to comply with the aforementioned periods, Alepia may still refund the Product(s) concerned. The sale shall be deemed firm and final.

In accordance with Article L.221-18 of the French Consumer Code, only products that are unsealed, unopened, unused, complete and undamaged may be subject to the right of withdrawal.

Europe and International extension: In accordance with the European Directive on consumer rights, the 14-day right of withdrawal applies to all customers residing within the European Union. For our customers residing in the United Kingdom, the same withdrawal rights and return conditions (14 days, costs borne by the customer for unsealed products) are guaranteed, in accordance with the Consumer Contracts Regulations.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are shipped by La Poste via COLISSIMO, a tracked delivery service, handed over without signature. Delivery times are given for information purposes only; if they exceed thirty days from the order, the contract of sale may be terminated and the buyer refunded. The company Alepia - La Maison d'Orient may provide the buyer by email with the tracking number of their parcel. The buyer is delivered to their home by their postal carrier. In the event of the buyer's absence, they will receive a delivery notice from their postal carrier, allowing them to collect the ordered products from the nearest post office within a period indicated by the postal services. The risks associated with transport are borne by the seller, in accordance with the provisions of Article L.216-4 of the French Consumer Code, which provides for the transfer of ownership upon delivery. The buyer is required to check, in the presence of the La Poste agent or the delivery person, the condition of the packaging of the goods and their contents upon delivery. In the event of damage during transport, any complaint must be made to the carrier within three days of delivery.

In accordance with Article L221-15 of the French Consumer Code, the seller is responsible for the delivery of the goods to the consumer, but only to the address provided by the latter. If the address provided by the customer is incorrect or incomplete, the seller shall not be held responsible for non-delivery.

Consequently, in the event of a return due to an address error, the seller is entitled to request additional charges for re-shipment.

Article 8. Warranty

All products supplied by the company Alepia - La Maison d'Orient benefit from the legal warranty provided for by Articles 1641 et seq. of the French Civil Code (Code civil).
The terms for exercising the legal warranty of conformity are provided for by Articles L.217-4 to L.217-13 of the French Consumer Code.
Thus, under Article L.217-4, the seller shall deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation where the latter has been made their responsibility by the contract or was carried out under their responsibility.
Under Article L.217-5: The goods conform to the contract:
1° If they are fit for the use ordinarily expected of similar goods and, where applicable:
- if they correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- if they possess the qualities that a buyer may legitimately expect having regard to the public statements made by the seller, the producer or their representative, in particular in advertising or labelling;
2° Or if they possess the characteristics defined by mutual agreement between the parties or are fit for any special use sought by the buyer, made known to the seller and accepted by the latter.

In the event of non-conformity of a product sold, it may be returned to the company La Maison d'Orient, which will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by email to [email protected] within thirty days of delivery.

Article 12. Dispute Resolution - Mediation

These distance-selling terms of sale are governed by French law.
Under Article R631-3 of the French Consumer Code, for any dispute or litigation, the consumer may bring the matter before either one of the courts with territorial jurisdiction under the Code of Civil Procedure, or the court of the place where they resided at the time the contract was concluded or the harmful event occurred.
The customer is informed of the possibility of resorting, in the event of a dispute, to a conventional mediation procedure or to any other alternative dispute resolution method.

In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, Alepia - La Maison d'Orient SARL adheres to the E-commerce Mediation Service of the FEVAD (Federation of E-commerce and Distance Selling), whose contact details are as follows: 60 Rue La Boétie - 75008 Paris, France. Article 13. Intended Use of Products — No Purchase for Resale

The website alepia.com is intended exclusively for retail sales to end consumers, for their personal or household needs. Purchasing products for the purpose of resale, whether on a regular or occasional basis, in any form and through any channel whatsoever (marketplaces, online stores, cross-border resale, etc.), is prohibited without ALEPIA’s prior written consent. Professionals wishing to distribute ALEPIA products are invited to contact ALEPIA to enter into a distribution agreement.

ALEPIA reserves the right to limit the quantities of any given product or range that may be ordered, per order, per customer, per delivery address, per payment method and/or per period. Orders which, by their volume, frequency or destination, show the characteristics of procurement for resale purposes may be refused or cancelled on this legitimate ground, with a full refund of any sums paid if the order has not been shipped.

Article 14. Single Customer Account — Use of Promotional Codes — Sanctions

Each customer (natural or legal person, or any person acting in concert with them) may hold only one customer account. Creating or using multiple accounts — in particular by means of different e-mail addresses referring to the same identity, the same delivery address or the same payment method — in order to circumvent a quantity limit, a promotional restriction or any other rule of the website, is prohibited.

Unless expressly stated otherwise: (i) only one promotional code may be used per order; (ii) codes may not be combined with each other or with other current offers; (iii) each code is limited to one use per customer, across all accounts; (iv) codes are valid only during their validity period and for the products they cover; (v) codes are personal and may not be transferred, published or exploited for commercial purposes. Any use of a code in breach of these terms — in particular through multiple accounts or after expiry — constitutes fraudulent use.

In the event of a breach of this Article or of Article 13, ALEPIA may, without prejudice to any damages: (i) cancel the orders concerned before shipment, with a refund of the sums paid; (ii) require payment of the normal price of the products for discounts fraudulently obtained on orders already shipped; (iii) suspend or delete the customer account(s) concerned; (iv) refuse any future order placed by the customer, by linked accounts, or for delivery to the same address. These measures constitute legitimate grounds for refusal of sale within the meaning of the applicable regulations. Furthermore, any reproduction or commercial re-use of ALEPIA’s trademarks, photographs, visuals and texts, in particular to present products for resale on third-party websites, is prohibited without prior written authorisation.
